These terms regulate the legal relations arising between the owner of a trading environment (Internet-shop) www.SuperKingitus.ee Estonia, registration number 14588095, email@example.com and the person who made the purchase (Customer).
1.2. Legal relations arising from the purchase of goods via the Internet-shop, regulated, in addition to these conditions, the laws of the Republic of Estonia.
1.3. The seller is entitled to amend the General conditions of the Internet shop, and prices of goods and services. Change notifications via the online shop. The deal is based on the conditions and prices applicable at the time of its implementation.
2.1. The displayed prices valid in the Republic of Estonia.
2.2. The fee for the selected delivery type shall be added to product prices during the placement of the order. The delivery type shall be chosen and the fee for delivery shall be calculated in the shopping cart.
2.3. If the Customer has a discount code, the discount on the item shall be calculated after entering the discount code in the shopping cart.
3.PLACEMENT OF ORDER
3.1. After the selection of the item and, if necessary, the item size, the item shall be added to the shopping cart by clicking on the button “Add to cart”.
3.2. In the shopping cart, the Customer may change the quantity of items and remove them from the cart.
3.3. To place the order, the Customer has to click on “Place order” – the Customer shall be directed to the order placement page. After entering the required data, the Customer shall be directed to the payment options page.
3.4. The order shall be considered placed after the payment of the invoice.
3.5. After payment, the Customer shall receive a confirmation of the order on their e-mail address.
4.1. The orders placed in the web environment shall be fully paid in advance.
4.2. The Customer may pay the invoice by Bank, credit cards (Visa, MasterCard) or the international payment environment PayPal or pay in cash on the spot (Tallinn).
4.3 If the invoice is not paid within 3 days, the order will be cancelled.
4.4. After the placement of the order and payment, the Customer shall receive an order confirmation via e-mail. An invoice shall be added to the goods upon delivery.
5. CANCELLATION OF ORDERS, RETURN OF PRODUCTS
5.1. The Customer is entitled to withdraw from the transaction within 14 calendar days as of the receipt of the goods (excluding item defect, see sub-clause “Warranty”). To return the products, the Customer must fulfill the returns form and return the items to : A.G.B. Disain OÜ office, or send it using SmartPost delivery service. GSM.: + 372 5567 2702.
The accompanying return costs shall be incurred by the Customer.
5.2 Not to be returned following goods: swaddle, diaper cakes, gifts of candy, hygiene products and cosmetics.
5.3. The returned item must be unused including all the labels and packaging. The return shall only be accepted together with a filled-out returns form.
5.4. The postal fees for the return of the item shall be incurred by the Customer. We recommend using registered mail.
6. ORDER CANCELLATION BY A.G.B. Disain OÜ.
1. If the goods ordered by the Customer are out of stock, the A.G.B. Disain OÜ shall cancel the order. The order may be cancelled partially or fully. The Customer shall be informed of the cancelled order immediately. In case of partial cancellation, the A.G.B. Disain OÜ may ask the Customer for specifications on how to process the rest of the order – whether to deliver or cancel as well.
6.2. Upon the cancellation of the order, the paid amount shall be returned to the Customer as soon as possible, but no later than within 30 days.
7.1. Upon discovering a non-conformity or defect, please inform the A.G.B. Disain OÜ thereof immediately.
7.3. The prerequisite of returning an item is the invoice issued to the Customer.
7.4. In the event of the non-conformity or defect of an item, the Customer is entitled to demand the replacement of the item with a defect-free item that corresponds to requirements or return the item at the A.G.B. Disain OÜ’s cost.
7.5. Upon returning an item in the event of non-conformity, the sum paid for the item, shall be transferred to the bank account indicated by the Customer within at least 30 days as of the return of the item.
7.6. The A.G.B. Disain OÜ shall not be responsible for the non-conformity or defects of the item, if:
7.6.1. The item has deteriorated/been damaged by the fault of the Customer.
7.6.2. The defects have emerged due to non-intended use, including failure to follow maintenance instructions;
7.6.3. The item has deteriorated due to natural wear and tear resulting from ordinary use.
8. OTHER TERMS AND CONDITIONS
8.1. The data regarding the Customers and their orders preserved in the ordering environment of the e-store are treated as confidential information. The A.G.B. Disain OÜ shall not disclose the acquired data to third parties.
8.2. Data communication between the Customer and the card payment centre is encrypted, guaranteeing the security of the Customer’s personal data and bank requisites. The A.G.B. Disain OÜ does not have access to the Customer’s confidential bank and payment card requisites.
8.3. Disputes arising between the Customer and The A.G.B. Disain OÜ shall be settled by negotiations. The A.G.B. Disain OÜ shall respond to the complaints of the Customer by e-mail within at least 7 working days. Upon failure to reach an agreement the Customer may turn to the Consumer Protection Board or Harju County Court.
The settlement of disputes shall proceed from the legislation of the Republic of Estonia.
